These Messaging Terms & Conditions ("Terms") govern the short message service ("SMS") and multimedia messaging service ("MMS") communications sent by Justus Stout for Rhea County ("the Campaign," "we," "us," or "our") to individuals who opt in to receive them. By providing your mobile phone number and opting in to our messaging program, you agree to these Terms.
1. Program Description
The Stout for Rhea County messaging program ("Program") delivers recurring text messages from Justus Stout for Rhea County Commissioner, District 5. Messages may include, but are not limited to, campaign updates, event invitations, voter-registration reminders, volunteer opportunities, fundraising appeals, get-out-the-vote messages, and other information related to the Campaign.
2. Opt-In
You may opt in to the Program by:
- Submitting your mobile number through the sign-up form on our website;
- Texting a keyword (such as JOIN or STOUT) to our short code or campaign number; or
- Providing your number on a paper or digital form at a campaign event and affirmatively consenting to receive messages.
By opting in, you consent to receive recurring automated marketing, informational, and fundraising text messages from the Campaign at the mobile number you provide. Consent is not a condition of any purchase, donation, or support.
3. Message Frequency
Message frequency varies and depends on your interactions with the Campaign and the phase of the election cycle. You should expect an increase in messages in the weeks leading up to an election.
4. Message & Data Rates
Message and data rates may apply to each text message sent or received in connection with the Program, as provided in your mobile service plan. Please contact your mobile service provider with any questions about your plan. Neither the Campaign nor the mobile carriers are liable for delayed or undelivered messages.
5. Opt-Out / How to Cancel
You can cancel the Program at any time by texting STOP, END, QUIT, UNSUBSCRIBE, or CANCEL to any message you receive from us. After you send the message, you will receive one confirmation message that you have been unsubscribed. You will not receive any further messages from us unless you opt in again. 7. Eligibility
The Program is intended for United States residents who are at least 18 years of age. By opting in, you represent and warrant that (a) you are at least 18 years old; (b) you are a United States resident; and (c) the mobile phone number you provided is yours, or you have authorization from the owner of the number to enroll it in the Program.
8. Supported Carriers
The Program is compatible with all major U.S. mobile carriers, including (but not limited to) AT&T, T-Mobile, Verizon Wireless, Sprint, Boost Mobile, Cricket Wireless, MetroPCS, U.S. Cellular, Virgin Mobile, and others. Carriers are not liable for delayed or undelivered messages.
9. Privacy
We respect your privacy and handle your information in accordance with our Privacy Policy. We do not sell, rent, or share mobile opt-in information or consent for text messaging with any third parties for their own marketing or promotional purposes. Phone numbers collected for the Program will only be used as described in these Terms and the Privacy Policy.
10. Prohibited Use
You agree not to use the Program in a manner that violates applicable law or these Terms. Abusive, harassing, or obscene responses to our messages may result in removal from the Program.
11. Changes to These Terms
We reserve the right to change or terminate the Program or these Terms at any time. Material changes will be posted on this page, and your continued participation in the Program after changes are posted constitutes your acceptance of the revised Terms.
12. Disclaimer of Warranty; Limitation of Liability
The Program is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, the Campaign disclaims all warranties, express or implied. The Campaign is not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your participation in or inability to participate in the Program.
